Two years ago Kaplan was given a ticket for using his cell phone to take a photo while driving. Kaplan fought the ticket and traffic court dropped the charge after accepting that the car was stopped when he used the phone. The three day suspension that he received along with the ticket has not been removed from his abstract and MPI refuses to remove it from his driving record.
